On August 23,2024, Delhi High Court issued key directives related to the petitions for admissions under economically Weaker sections (EWS) and Disadvantaged group (DG) quotas in private schools across the state.
The focus is that , children belonging to the disadvantaged backgrounds should not be forced to accept educational inequalities as their destiny .

Justice, Swarna Kanta Sharma directed schools to appoint a dedicated nodal officer to manage the admissions for EWS and DG quotas.

In addition, the court mandated that admissions-related circulars , instructions and notice must be available in English and Hindi, both. So it is convenient for parents.
The schools should provide a clear schedule mentioning the specific date and time for each student's admission.


While analysing the petitions the court noted the following concerns with the admission process:

- There was a lack of smooth and seamless transition between the Junior wing and Senior wing of the same school.
- Both, children and parent found it challenging
- also the potential financial hardship or parental indifference may disrupt the pursuit of legal remedies.
- Existence of separate school IDs for each wind of school is detrimental to the student's academic progress.

The court also stated about the Right to Education (RTE) Act . How it was established to ensure that access to private education is not restricted to children from affluent families, and it mandates that all students be treated with equal concern and respect.

The schools governed by the act must uphold the following principles
-Equal treatment to all children, including the children from EWS/DG category
-Ensure these children are not made feel less valued than their advantaged peers.
-It is state's responsibility to uphold the self-respect of these children and make sure they are not neglected.
-All stakeholders should work towards a seamless integration of all students.

It is the role of constitutional courts to address and remove any obstacles that may hinder this vital process, ensuring that the path to education remains clear and accessible for all who will shape the future of our nation," said the court.
